Officials in Prince William County, Virginia, have filed a federal lawsuit against the Department of Homeland Security (DHS) in connection with a case involving an illegal immigrant who has been charged with killing a nun.



The Washington Examiner reports that county officials want access to the records on Carlos Martinelly-Montano.



According to the news source, Martinelly-Montano, is an illegal immigrant who was arrested and charged with killing a nun and critically injuring two others while driving drunk in August 2010. He reportedly had two earlier DUI convictions and is currently awaiting a deportation trial after being released by U.S. Immigration and Customs Enforcement. Martinelly-Montano was reportedly released because he wasn't considered a flight risk.



The Board of Supervisors of Prince William County reportedly filed the suit after they allege they had tried to obtain any communication between Martinelly-Montano and the DHS prior to the arrest through a Freedom of Information Act request.



The board is also reportedly seeking a congressional investigation into the department's handling of immigration records and has announced that it may file an additional lawsuit in order to get information of other illegal immigrants who were released back into the community.
